These Terms of Service ("Terms") govern your access to and use of marlowe-and-co.com (the "Website") and your purchase or use of products and services offered by Marlowe & Co.

By accessing or using this Website, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, each of which is incorporated into these Terms by reference.

If you do not agree to these Terms, you should not use the Website or place an order through it.

1. Company Information

Marlowe & Co is a brand operated by Digital Edamon Ltd.

2. Eligibility

You must be at least 18 years old, or otherwise have the legal capacity required under the laws applicable to you, to enter into a binding contract and place an order through this Website.

By placing an order, you represent that the information you provide is accurate, current, and complete and that you are authorized to use the payment method submitted with your order.

3. Website Use

You may use this Website only for lawful personal or commercial purposes that do not violate these Terms or applicable law.

You agree not to:

  • Use the Website for fraudulent or unlawful purposes;
  • Attempt to gain unauthorized access to the Website, our systems, or other users' accounts;
  • Introduce viruses, malicious code, automated scraping tools, or other harmful technologies;
  • Interfere with the security, availability, or proper operation of the Website;
  • Use false information to place orders or obtain products improperly;
  • Copy or exploit Website content in violation of our intellectual property rights.

We reserve the right to restrict or terminate access to the Website where we reasonably believe these Terms have been violated.

4. Products & Product Information

Marlowe & Co is a general merchandise and lifestyle retailer offering a variety of products, which may include clothing, home products, bedding, accessories, insoles, candles, wallets, and other consumer goods.

We make reasonable efforts to display product descriptions, photographs, measurements, specifications, materials, colors, availability, and other information accurately.

However, minor variations may occur. For example, colors may appear slightly different depending on your screen, device, lighting conditions, manufacturing batch, or product materials.

Unless a particular characteristic is expressly guaranteed on a product page, minor non-material variations do not necessarily mean that a product is defective or incorrectly supplied.

We reserve the right to update, modify, discontinue, or replace products and product information at any time.

5. Orders

Submitting an order through our Website constitutes an offer to purchase the products in your cart.

All orders are subject to acceptance, product availability, payment authorization, fraud screening, and any other reasonable verification we may need to perform.

We reserve the right to refuse, limit, or cancel an order where reasonably necessary, including where:

  • A product is unavailable;
  • There is an obvious pricing or product-information error;
  • Payment authorization fails;
  • We reasonably suspect fraud, abuse, or an unauthorized transaction;
  • The shipping destination is not supported;
  • An order violates these Terms or applicable law.

If we cancel an order after payment has already been collected, the applicable amount will be refunded to the original payment method.

6. Pricing, Taxes & Payment

Prices displayed on the Website are shown in the currency indicated at the time of purchase.

Applicable shipping costs, duties, taxes, or other charges will be displayed or handled as described during checkout or in our relevant policies, where applicable.

By submitting an order, you authorize Marlowe & Co and its payment service providers to charge the payment method you select for the total amount shown at checkout.

You represent that you are authorized to use the payment method provided and that the billing information you submit is accurate.

We make reasonable efforts to ensure pricing is accurate. However, errors may occasionally occur.

If an obvious pricing error is discovered before fulfillment, we may contact you to offer the option of purchasing the item at the correct price or cancelling the affected item or order for a refund.

7. Promotions, Discounts & Coupon Codes

From time to time, Marlowe & Co may offer promotional prices, discount codes, bundle offers, free gifts, free shipping promotions, or other special offers.

Unless otherwise stated:

  • Promotions cannot be exchanged for cash;
  • Promotional codes may not be combined with other offers;
  • Discounts must be applied before checkout is completed;
  • Promotions may be limited by product, customer, territory, or date;
  • We may withdraw or modify a promotion before an order is placed.

If part of an order purchased under a bundle, free-item, or promotional offer is returned, any refund may be adjusted to account for the promotional value or discount originally received, as explained in our Return & Refund Policy.

8. Returns, Refunds & Exchanges

Eligible products may be returned in accordance with our Return & Refund Policy.

Our standard return window for eligible products is 30 days from delivery, subject to the conditions and exceptions set out in that policy.

Depending on the product, returned items may need to be unused, unworn, unwashed, unaltered, undamaged, and in their original condition.

Certain items may not be eligible for change-of-mind returns because of their nature, customization, hygiene considerations, or because they were clearly identified as Final Sale before purchase.

Nothing in these Terms or our Return & Refund Policy limits any mandatory rights available to you under applicable consumer law.

9. Damaged, Defective or Incorrect Products

If a product arrives damaged, defective, materially different from what was ordered, or if we send you the wrong product, please contact us as soon as reasonably possible.

We may ask you to provide your order number, photographs, video, packaging information, or other reasonable evidence so that we can investigate the issue.

Where appropriate, we may provide a replacement, refund, reshipment, repair, or another remedy in accordance with applicable law and our Return & Refund Policy.

10. Order Cancellations & Changes

If you need to cancel or modify an order, please contact us as quickly as possible.

We will make reasonable efforts to accommodate requests received before fulfillment begins.

However, orders may enter processing shortly after they are placed. Once an order has been processed, transferred to a fulfillment partner, or shipped, we may no longer be able to cancel or modify it.

Where cancellation is no longer possible, you may still have the right to return an eligible product after delivery in accordance with our Return & Refund Policy and applicable consumer law.

11. Shipping & Delivery

Shipping methods, estimated delivery timeframes, tracking procedures, and other delivery information are described in our Shipping Policy.

Delivery dates and timeframes are estimates unless expressly stated otherwise. Actual delivery times may be affected by carriers, customs, weather, holidays, high-volume periods, local delivery conditions, or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address.

If you notice an error in your shipping information, please contact us as soon as possible. We cannot guarantee that an address can be changed once fulfillment has begun.

12. Fulfillment Partners

Marlowe & Co may use third-party manufacturers, fulfillment centers, warehouses, logistics providers, and shipping carriers to process and deliver orders.

As a result, products within the same order may occasionally be fulfilled from different locations or arrive in separate parcels.

The return address for a product may also differ from the address from which the parcel was originally shipped.

Customers should therefore follow the return instructions provided by our customer care team rather than sending products to an address printed on the original parcel.

13. Delivery Issues

If an order is delayed, missing, returned to sender, or shown as delivered but cannot be located, please contact us so we can review the available tracking and delivery information.

Where appropriate, we may ask you to check with household members, neighbors, reception areas, mailrooms, building management, or the local carrier.

Orders returned because of an incorrect or incomplete address supplied by the customer, refusal of delivery, or failure to collect a parcel may be subject to additional shipping costs if reshipment is requested, where permitted by law.

14. Risk of Loss

Responsibility for products and risk of loss will transfer in accordance with applicable law and the delivery terms applicable to your transaction.

Nothing in these Terms is intended to transfer risk to a consumer earlier than permitted under mandatory consumer protection law.

15. Chargebacks & Payment Disputes

We encourage customers to contact us before initiating a payment dispute or chargeback whenever reasonably possible.

Our customer care team can often investigate delivery, product, billing, or refund issues more quickly through direct communication.

If a chargeback, payment dispute, reversal, or similar claim is initiated, Marlowe & Co may provide relevant information to the applicable payment processor, card issuer, bank, or dispute-resolution provider in order to respond to the claim.

Depending on the circumstances, this information may include:

  • Order and transaction information;
  • Billing and shipping information;
  • Payment authorization records;
  • Carrier tracking information;
  • Delivery confirmation;
  • Customer communications;
  • Website and checkout records;
  • Device, browser, IP address, or fraud-prevention information where lawfully collected;
  • Relevant terms, policies, and order records.

We reserve the right to contest disputes we reasonably believe are invalid or fraudulent and to restrict future purchases where there is evidence of payment abuse, fraud, or repeated misuse.

Nothing in this section prevents you from exercising legitimate rights available through your bank, card issuer, payment provider, or applicable consumer protection law.

16. Product Use

Products purchased from Marlowe & Co should be used only for their intended purpose and in accordance with any instructions, labels, warnings, care guidance, or safety information supplied with the product.

You are responsible for reviewing product information before use and for using reasonable care appropriate to the product.

Marlowe & Co is not responsible for damage resulting from misuse, unauthorized modification, failure to follow instructions, improper storage, or use of a product in a manner for which it was not intended, except where liability cannot legally be excluded.

17. Product-Specific Information

Because Marlowe & Co sells a variety of products, some items may be subject to specific instructions, warnings, sizing recommendations, care requirements, or usage limitations.

These may appear on the product page, packaging, product label, instruction sheet, or other documentation supplied with the product.

You should review such information before using a product.

18. No Professional Advice

Unless expressly stated otherwise, information provided on the Website is for general informational purposes only.

Content relating to comfort, lifestyle, wellness, posture, sleep, home use, product functionality, or similar topics should not be interpreted as medical, legal, financial, or other professional advice.

Products such as insoles, bedding, lifestyle accessories, or other consumer goods are not intended to diagnose, treat, cure, or prevent a medical condition unless expressly identified and legally marketed for such a purpose.

If you have a health or medical concern, you should seek advice from an appropriately qualified healthcare professional.

19. Reviews & User Content

If you submit a review, photograph, testimonial, comment, feedback, or other content to Marlowe & Co, you confirm that you have the right to submit that content and that it does not infringe the rights of another person.

You must not submit content that is unlawful, fraudulent, defamatory, abusive, misleading, obscene, or otherwise inappropriate.

Where you voluntarily submit content for publication or promotional use, you grant Marlowe & Co a non-exclusive, royalty-free license to use, reproduce, display, and distribute that content for legitimate business and marketing purposes, subject to applicable privacy and consumer laws.

20. Intellectual Property

Unless otherwise stated, the Website and its contents, including the Marlowe & Co name, logos, branding, designs, graphics, photographs, videos, text, product descriptions, page layouts, and other materials, are owned by or licensed to Marlowe & Co / Digital Edamon Ltd.

These materials are protected by applicable copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, republish, distribute, modify, commercially exploit, or create derivative works from our content without our prior written permission, except where permitted by law.

21. Third-Party Services & Links

Our Website may contain links to third-party websites, payment services, tracking services, social networks, or other external platforms.

These third-party services are operated independently from Marlowe & Co. We are not responsible for their content, availability, privacy practices, or terms.

Your use of third-party services may be subject to separate terms and policies provided by those third parties.

22. Independent Brand Notice

Marlowe & Co is an independent brand.

Unless expressly stated otherwise, Marlowe & Co is not affiliated with, endorsed by, sponsored by, or officially associated with any third-party company, brand, manufacturer, organization, product, service, or trademark mentioned or depicted on the Website.

Third-party trademarks remain the property of their respective owners.

23. Availability & Sales Territories

The availability of products and shipping destinations may vary depending on the product, fulfillment location, applicable laws, carrier availability, and other operational considerations.

The destinations currently available for an order will generally be shown during checkout.

We reserve the right to restrict, refuse, or cancel orders to destinations that we do not currently support or where fulfillment would violate applicable law.

24. Fraud Prevention & Order Verification

To protect our customers and our business, orders may be subject to automated or manual fraud-prevention checks.

In some circumstances, we may request additional information reasonably necessary to verify an order, payment, billing information, or shipping details.

We reserve the right to delay, refuse, or cancel orders where we reasonably believe a transaction may be fraudulent, unauthorized, abusive, or otherwise unlawful.

25. Account Security

If the Website allows you to create a customer account, you are responsible for maintaining the confidentiality of your login details and for activity occurring through your account.

Please contact us if you reasonably believe your account or payment information has been used without authorization.

26. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Website is provided on an "as is" and "as available" basis.

We do not guarantee that the Website will always be uninterrupted, completely error-free, or free from technical issues.

Products remain subject to any warranties, guarantees, conformity requirements, and consumer protections that cannot legally be excluded or limited.

Nothing in these Terms excludes any warranty or legal guarantee that must apply under applicable law.

27. Limitation of Liability

To the maximum extent permitted by law, Marlowe & Co and Digital Edamon Ltd will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses that were not reasonably foreseeable and that arise from your use of the Website or products.

Where legally permitted, our total aggregate liability in connection with a particular product or order will not exceed the amount paid by you for the product or order giving rise to the claim.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:

  • Death or personal injury caused by negligence where such liability cannot be excluded;
  • Fraud or fraudulent misrepresentation;
  • Mandatory consumer rights;
  • Any other liability that cannot legally be excluded or limited.

28. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Marlowe & Co, Digital Edamon Ltd, and their officers, directors, employees, contractors, and service providers from claims, losses, liabilities, damages, and reasonable costs arising directly from your unlawful misuse of the Website, fraudulent conduct, or material breach of these Terms.

This provision does not apply to the extent that a claim results from our own breach of law, negligence, or misconduct.

29. Consumer Rights

These Terms establish the contractual conditions governing purchases from Marlowe & Co but are not intended to remove or restrict rights that consumers cannot legally waive.

Depending on where you live, applicable laws may provide additional rights regarding cancellation, withdrawal, returns, refunds, defective products, product conformity, warranties, delivery, repairs, or replacements.

Where these Terms conflict with a mandatory consumer protection rule applicable to you, the mandatory legal rule will prevail.

30. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales, except where mandatory consumer protection laws in your country or region require otherwise.

If a dispute arises, we encourage you to contact us first at hello@marlowe-and-co.com so that we can try to resolve the matter informally and in good faith.

Nothing in these Terms deprives a consumer of the protections of mandatory laws or courts that apply in their place of residence.

31. Force Majeure

We will not be responsible for delays or failures caused by circumstances outside our reasonable control, to the extent permitted by law.

Such circumstances may include natural disasters, severe weather, carrier disruptions, strikes, customs delays, governmental actions, war, civil disturbance, infrastructure failures, cyber incidents, epidemics, pandemics, or other events that materially prevent normal fulfillment or operation.

Where such an event occurs, we will make reasonable efforts to minimize its impact and fulfill our obligations as soon as reasonably possible.

32. Policy Abuse & Refusal of Service

We reserve the right, to the extent permitted by law, to refuse future service, cancel orders, restrict accounts, or take other reasonable protective measures where there is credible evidence of:

  • Fraudulent transactions;
  • Repeated payment abuse;
  • Return or refund fraud;
  • False claims;
  • Harassment or threats toward our staff or service providers;
  • Attempts to exploit promotions or Website functionality dishonestly;
  • Other unlawful or materially abusive behavior.

This section does not affect legitimate complaints, returns, refunds, disputes, or consumer rights exercised in good faith.

33. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, Website, products, services, policies, or applicable legal requirements.

The latest version will be posted on this page together with an updated "Last updated" date.

Unless otherwise required by law, updated Terms will apply prospectively and will not retroactively remove rights associated with orders placed under an earlier version.

34. Severability

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

35. No Waiver

If we do not enforce a provision of these Terms immediately, that does not mean we waive our right to enforce it later.

36. Entire Agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and any other policies expressly incorporated by reference, constitute the agreement between you and Marlowe & Co concerning your use of the Website and purchases made through it.
